New legal requirements for passenger elevators without CE marking in Upper Austria.
6.5 billion people use one of over 100,000 elevators in Austria every year. More than half of these elevators are more than 20 years old. The safety standards of new elevators have been constantly improved over the years. However, old elevators still comply with the safety standards that were valid at the time they were built .
The Upper Austrian elevator ordinance amendment comes into force on 1.8.2025 (ATTENTION: elevator evaluation required!)
What does the Upper Austrian elevator ordinance amendment regulate?
With the Upper Austrian Lift Ordinance Amendment 2025, operators of elevators are obliged to have existing passenger elevators that were not placed on the market in accordance with the provisions of the Lift Safety Ordinance (ASV 1996; ASV 2008; ASV 2015) and do not bear the CE mark subjected to a safety inspection by a test center for elevators in accordance with § 18 Lift Operating Ordinance 2009.
What does the new Upper Austrian elevator ordinance amendment mean in concrete terms for elevator operators?
Older passenger elevators that were approved prior to or in 1999 do not comply with the current Lift Safety Ordinance. Operators must therefore arrange for a safety inspection (evaluation) by an approved inspection body for elevators in accordance with § 6a Para. 1 (Upper Austrian Lift Ordinance 2010).
Procedure description
The safety inspection and the measures to be taken must be carried outin accordance withthe requirements of §§ 20 to 22 HBV 2009.
HBV 2009 – Excerpt from § 21
Step 1:
The operator must entrustan inspection body for elevators in good time in relation to the date specified below with the survey of the system condition of the elevator by means of a safety inspection….
Step 2:
The inspection body for elevators must preparean inspection report …….
Step 3:
On the basis of the test report, the operator must plan the appropriate remedial measures …….., (note: in any case within six months of receiving the test report) and demonstrably informthe inspection body of the test report, the planning preview and the planning documents.
Step 4:
The inspection body (elevator inspector) must check the remedial measures provided by the operator for their suitability with regard to the deviations identifiedin the inspection report …………
Step 5:
The inspection body (elevator inspector) is responsible for checking that the corrective measures have been carried out correctly. They must enter a corresponding note in the elevator logbook.
