The water law authority may appoint suitable supervisory bodies by official decision to monitor the construction of water facilities requiring approval (Austrian law: Section 120 WRG 1959). A natural or legal person or other company with legal personality may be appointed. If a legal person is appointed, it must designate one or more natural persons to perform the tasks on its behalf. In this case, each of the designated natural persons must demonstrate their suitability.
The building supervision extends to the professional and proper execution of the construction work and to compliance with the relevant conditions of the approval notice.
The supervisory bodies are entitled to carry out investigations, measurements, and tests on the construction site at any time. Furthermore, the building inspectorate may demand access to aids, documents, and the like, and, if necessary, object to building materials, components, and structural measures. If no agreement is reached, the decision of the water rights authority must be obtained without delay.
The bodies of the water law building inspectorate are obliged to maintain the confidentiality of any trade and business secrets that come to their knowledge.
We take on project management and the official processing of measures that require approval under water law. Applications for the construction of power plants on streams or rivers, the construction of artesian wells, drainage systems, protective or regulatory water structures, etc. must be submitted to the relevant water authority.
